AGREEMENT TO OUR LEGAL TERMS

Forever-on-bitcoin.com provides users with the service of inscribing a message into a Bitcoin transaction. We do not sell, trade, or custody Bitcoin or other cryptocurrencies. The service focuses exclusively on permanently storing personal messages on the Bitcoin blockchain.

These Legal Terms constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you"), and Jakob Amann concerning your access to and use of the Services. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

The Services are intended for users who are at least 18 years old. Persons under the age of 18 are not permitted to use or register for the Services.

1. OUR SERVICES

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation.

Service Description: We provide a technical service for inscribing messages into Bitcoin transactions using OP_RETURN functionality. The service is aimed at individuals without in-depth technical knowledge of the Bitcoin blockchain.

Execution Instructions: Customers may add comments regarding their desired order execution (e.g., preferred execution time). However, due to the nature of the Bitcoin blockchain, we cannot guarantee specific execution times or conditions.

2. INTELLECTUAL PROPERTY RIGHTS

Our intellectual property

We are the owner or licensee of all intellectual property rights in our Services, including all content and trademarks.

Your use of our Services

Subject to your compliance with these Legal Terms, we grant you a non-exclusive, non-transferable, revocable license for personal, non-commercial access to and use of the Services.

Your contributions

You are fully responsible for all messages or content you transmit through our Services. You grant us an unrestricted, worldwide, royalty-free license to use your contributions in connection with providing the Services.

Pricing: All payments are in Euros. The current price for our service is €21 per message.

Payment Processing: Payment processing is handled through Stripe. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Services.

We reserve the right to refuse or limit orders.

5. REFUND AND RETURN POLICY

General Principle: Due to the irreversible nature of blockchain transactions, all sales are generally final.

Exception: Refunds are only possible as long as the Bitcoin transaction has not yet been published to the blockchain. In this case, you may request a full refund.

Right of Withdrawal: As a consumer, you have the right to withdraw from this contract within fourteen days without giving any reason, provided the service has not been fully performed. The right of withdrawal expires once the Bitcoin transaction has been published to the blockchain.

6. PROHIBITED ACTIVITIES

You are prohibited from:

Using the Services for illegal purposes

Transmitting harmful, offensive, defamatory, or otherwise objectionable content

Submitting messages that violate German laws

Disrupting or damaging the technical infrastructure of the Services

Transmitting viruses, malware, or other harmful code

7. LIMITATION OF LIABILITY

Services "as is": The Services are provided "as is" and "as available." We disclaim all warranties to the extent legally permissible.

Limitation of Liability: Our liability is limited to the amount paid by you, to the extent legally permissible. This does not apply to damages from injury to life, body, or health, as well as for intent and gross negligence.

Special Blockchain Risks: We are not liable for:

Delays in Bitcoin transaction confirmations

Network fee fluctuations

Technical problems of the Bitcoin network

Loss or inaccessibility of blockchain data

8. PRIVACY

We treat your personal data in accordance with our Privacy Policy and GDPR. The Services are hosted in Germany.

9. GOVERNING LAW AND JURISDICTION

These Legal Terms are governed by German law. As a consumer with habitual residence in the EU, you additionally benefit from the protection provided by the mandatory provisions of the law of your country of residence.

The place of jurisdiction for all disputes is Konstanz, Germany, insofar as you are a merchant, legal entity under public law, or special fund under public law.
